8. TERMS AND CONDITIONS PERTAINING TO THE TENANT IN RESPECT OF THIS
8.1. The TENANT consents that the AGENT/LANDLORD shall be entitled to contact, request and obtain
information (for the avoidance of doubt this includes any and all information held on my profile by
registered credit bureaux including rental and credit payment profile information) from registered
credit bureaux to perform an assessment of my behaviour, profile, payment patterns, indebtedness,
whereabouts, and creditworthiness in any format (including in pdf, xml or raw data string) available
from such credit bureaux and to continuously access my information from such bureaux for as long as I
may have a relationship with the AGENT/LANDLORD, make any reasonable enquiries to verify and research
any details provided by me to the AGENT/LANDLORD; and to access the information in any format,
including online, batch and raw xml string.
8.2. Furthermore, I hereby declare that the details furnished herein are true and correct to the best
of my knowledge and belief.
8.3. I hereby confirm that I have personally inspected the premises applied for.
8.4. In the event that the signatory accepts this LEASE in a representative capacity, then such
person warrants that he or she is duly authorised thereto.
8.5. Any information given by the signatory, which is fraudulent and/or purposefully given to mislead
the LANDLORD and/or Adrienne Hersch Properties will be seen as an unlawful act and the LANDLORD, Adrienne Hersch Properties and
or their appointed representative reserves the right to prosecute such party criminally which will
cause the LEASE to be null and void.
8.6. Should the TENANT default in any manner whatsoever the LANDLORD, Adrienne Hersch Properties or their
appointed representative reserves the right to submit such information to a credit bureau or any
similar company to list such party as a default payer and to enforce the terms of this LEASE by
instituting legal action against such defaulting party and where appropriate, the LANDLORD, Adrienne Hersch Properties or their representative reserves the right to prosecute such defaulting party criminally.
8.7. The TENANT acknowledges that cash deposits are not accepted at the offices of Adrienne Hersch Properties, all
cash deposits are to be made directly into the bank account as prescribed by Adrienne Hersch Properties or as set
out in the pursuant LEASE, and the cost thereof shall be paid by the TENANT.
